     1.   OBJECTIVES.  To implement sound stewardship practices that are protective of the air,
     water, land, and cultural and ecological resources impacted by Department of Energy
     (DOE) operations and by which DOE cost effectively meets or exceeds compliance with
     applicable environmental; public health; and resource protection laws, regulations, and
     DOE requirements.  This objective will be accomplished by implementing Environmental
     Management Systems (EMSs) at DOE facilities as part of their Integrated Safety
     Management Systems (ISMSs) established pursuant to DOE P 450.4, Safety Management
     System Policy, dated 10-15-96.

     2.   CANCELLATION.  DOE O 5400.1, General Environmental Protection Program, dated
     11-9-88 and DOE N 450.4, Assignment of Responsibilities for Executive Order 13148,
     Greening the Government Through Leadership in Environmental Management, dated
     2-05-01.  Cancellation of a Directive does not, by itself, modify or otherwise affect any
     contractual obligation to comply with the Directive.  Cancelled Directives that are
     incorporated by reference in a contract remain in effect until the contract is modified to
     delete the references to the requirements in the cancelled Directives.

            <SectionTitle><![CDATA[3. Applicability]]></SectionTitle>
            <SectionContent><![CDATA[
     3.   APPLICABILITY.

               a.   DOE Elements.

                         (1)  Except as noted in paragraph 3c, this Order applies to all DOE elements
               listed on Attachment 1 that are responsible for the management and
               operation of the Department's facilities, including elements of the National
               Nuclear Security Administration and power administrations.

                         (2)  Where ISMSs are not applicable, DOE elements must implement EMSs
               but are not required to integrate them into ISMSs.  These DOE elements
               must interpret all references to ISMSs within this Order to mean EMSs.

               b.   DOE Contractors.

                         (1)  The Contractor Requirements Document (CRD), Attachment 2, sets forth
               requirements of this Order that will apply to contractors responsible for the
               management and operation of the Department-owned facilities whose
               contracts include the CRD.

                   (2)  This CRD must be included in all management and operating contracts
            and any other contract that contains DOE Acquisition Regulation (DEAR)
            clause 970.5204-2, "Laws, Regulations, and DOE Directives."

                   (3)  The office identified in the responsibilities paragraphs is responsible for
            notifying the contracting officer of which contracts are affected.  Once
            notified, the contracting officer is responsible for incorporating the CRD
            into each affected contract via the laws, regulations, and DOE directives
            clause of the contract.

                   (4)  As the laws, regulations, and DOE directives clause states, regardless of
            the performer of the work, a contractor with the CRD incorporated into its
            contract is responsible for compliance with the requirements of the CRD. 
            An affected contractor is responsible for flowing down the requirements of
            this CRD to subcontracts at any tier to the extent necessary to ensure the
            contractor's compliance with the requirements.

         c.   Exclusions.

                   (1)  Activities conducted under the authority of the Director, Naval Nuclear
            Propulsion Program, as described in Executive Order 12344 and set forth
            in Public Laws 98-525 and 106.65.

                   (2)  Activities conducted by the Bonneville Power Administration as
            authorized by Delegation Order No. 0204-161.

                   (3)  Activities conducted by the Office of the Secretary, Chief Information
            Office, Office of Congressional and Intergovernmental Affairs, Office of
            Counterintelligence, Departmental Representative to the Defense Nuclear
            Facilities Safety Board, Office of Economic Impact and Diversity, Energy
            Information Administration, Office of General Counsel, Office of
            Hearings and Appeal, Office of Inspector General, Office of Intelligence,

The mechanism for attaching CRDs to facilities contracts is the “Laws, regulations and directives” clause, which is not used in non-facilities management contracts.  This directive and CRD does not apply to other than facilities management contracts.

       4.     REQUIREMENTS.

         a.   All DOE elements must ensure their ISMSs include an EMS that does the
       following.

                   (1)  Provides for the systematic planning, integrated execution, and evaluation
            of programs for 

                             (a)  public health and natural and cultural resource protection,

                             (b)  pollution prevention (P2), and

                             (c)  compliance with applicable environmental protection
                 requirements.

                   (2)  Includes policies, procedures, and training to identify activities with
            significant environmental impacts, to manage and control these activities,
            and to assess performance and implement corrective actions where needed. 

                   (3)  Includes measurable environmental goals, objectives, and targets that are
            reviewed annually and updated when appropriate.

         b.   As part of their ISMSs, DOE elements must do the following.

                   (1)  Promote the long-term, sustainable stewardship of a site's natural and
            cultural resources throughout its operational, closure, and post-closure life
            cycle until the time that DOE's liability has ended.

                   (2)  Reduce or eliminate the generation of waste, the release of pollutants, and
            the release of ozone-depleting substances (ODS) to the environment
            through source reduction, re-use, segregation, and cost-effective recycling
            and by procuring recycled-content materials and environmentally
            preferable products and services.

                   (3)  Ensure the early identification of potential adverse environmental impacts
            associated with DOE operations, including, as appropriate, preoperational
            characterization and assessment, and effluent and ambient monitoring.

                   (4)  Implement appropriate prevention, control, mitigation, and/or remedial
            measures where adverse impacts are identified.

         c.   As part of integrating EMSs into their ISMSs, DOE elements must do the
       following.

                   (1)  Incorporate procedures that protect all environmental media at their sites
            in an integrated manner.

                   (2)  Consider the following elements for inclusion as appropriate:

                             (a)  conformity of DOE proposed actions with State implementation
                 plans to attain and maintain national ambient air quality standards,

                             (b)  implementation of a watershed approach for surface water
                 protection,

                             (c)  implementation of a sitewide approach for groundwater protection,

                             (d)  protection of biota,

                             (e)  protection of site resources from wildland and operational fires,
                 and

                             (f)  protection of cultural resources.

It should be noted that the protection of cultural resources is not mentioned in ISO 14001 or EO 13148.  DOE Order 5400.1 does not emphasize the protection of cultural resources either.  The inclusion of cultural resources in this Order detracts from the main focus of the Order, specifically, the prevention of pollution and compliance with environmental regulations.  This comment applies to paragraphs: 450.1 1, 4.(a)(1a), 4.(b)(1), and 4.(c)(2)(f).

Remove both of these sections.  Protection of site resources from fires is not an element of an environmental management system.  There is no such requirement in ISO 14001.  The purpose of an environmental management system is to ensure a commitment to the prevention of pollution and compliance with environmental regulations.  The protection of property is covered in other DOE Orders.  This comment applies to paragraphs: 450.1 4.(c)(2)(e).

1. Section 4 Requirements, a(1)a: Most EMSs require a strong stance on public involvement. The words 'public health' and 'cultural resource protection' do not encompass opportunities for DOE to involve itself in open public dialog. Examples of public involvement could be: DOE-funded mentorship programs for local businesses involving technology transfer of pollution prevention, sustainability and/or other environmentally related sciences or requiring involvement in local environmental issues such as groundwater, energy conservation, etc. A dialogue such as this could greatly enhance DOE's stance with the public on issues near and dear to DOE, such as nuclear waste transport and disposal. 


2. Section 4 Requirements, b(4): 
This section requires 'prevention, control, mitigation, and /or remedial measures where adverse impacts are identified.'EMSs require the organization to have strong preventative measures in place. The words 'control, mitigation and remedial measures' leaves the possibility open that environmental insults will be tolerated. Strengthen this section to stress the importance of the prevention-based system that does not pre-suppose that environmental damage is a part of doing business but, conversely, pre-supposes that it is NOT a part of doing business.


3. Section 4 Requirements, c.: Require and define sustainability as it 
pertains to purchases, buildings, and projects. Sustainability considers the entire life-cycle of a project, building or operation. It considers energy use, water use, and resource use over the life of the project or building. It considers these issues up-front in early design stages. For instance, designing an HVAC system after energy-saving measures have been designed such as daylighting and windows with improved R-values can reduce the size requirements for the HVAC system, as well as long-term energy costs.

The purpose of this Order is to establish a requirement to establish an EMS integrated into ISMS, and to set forth certain elements that should be considered. Nothing in this Order precludes DOE sites from taking a strong stance on public participation. 


















































4.b.(4)Reject.  An EMS cannot presume to prevent pollution 100% of the time. Therefore, some mechanism is needed to address these situations as they develop.

4.c. Reject. An EMS requires sound stewardship practices, which include sustainability. It is up to site and bldg mangers to define significant environmental impacts associated with bldgs and operations at their sites. These issues should be identified as a result of aspects/impacts identification in an EMS.
This topic is more appropriately addressed in guidance.  

4.a.2.Reject.  Use of the suggested language is too narrow.  
The focus here is on significant environmental impacts.  Most DOE emissions and effluents do not result in such impacts.   

4.a.2.Reject.  Corrective actions are necessary for the back end of the process. P2 is needed at the front end of the pollution-generating process. P2 cannot eliminate everything, although it can reduce the need for corrective actions.

       5.     RESPONSIBILITIES.  All DOE elements, as specified in paragraph 3a of this Order, are
       responsible for implementing the requirements specified in paragraph 4.  Corporate
       responsibilities for management of environment, safety and health assigned to DOE
       elements are delineated in Section 9 of DOE M 411.1-1B, Safety Management Functions,
       Responsibilities, and Authorities Manual, dated 5-22-01.  Specific responsibilities for
       implementing this Order are set forth below. 

         a.   Assistant Secretary for Environment, Safety and Health, in coordination with
       other DOE elements, must do the following.

                   (1)  Develop or revise, as needed, existing DOE environmental protection
            directives, policies, guidance, requirements, and procedures to 

                             (a)  provide instruction through the Environment, Safety and Health
                 (ES&H) Supplemental Budget Guidance for the inclusion of the
                 requirements of this Order in ES&H management plans developed
                 by the Lead Program Secretarial Office (LPSO), other Program
                 Secretarial Offices (PSOs) as appropriate, and field offices;

                             (b)  provide guidance to PSOs and field organizations for ensuring their
                 ISMSs provide for EMSs that promote the protection of the
                 environment, efficient compliance with environmental
                 requirements, and enhanced environmental performance in the
                 conduct of DOE operations (guidance must include instruction for
                 integration of EMS self-assessment requirements into ISMS self-
                 assessment protocols); and

                             (c)  maximize the use of safe alternatives to, evaluate present and
                 future uses of, and disseminate information regarding successful
                 efforts to phase out ODS.
  
                   (2)  Serve as the Agency Environmental Executive pursuant to Executive
            Order 13101, "Greening the Government Through Waste Prevention,
            Recycling and Federal Acquisition," with responsibility for 

                             (a)  coordination, in conjunction with the Office of  Management,
                 Budget and Evaluation, of environmental programs relating to
                 waste prevention, recycling, and acquisition;

                             (b)  preparation of annual corporate reports on the Department's
                 progress in implementing Executive Order 13101 and Executive
                 Order 13148, "Greening the Government Through Leadership in
                 Environmental Management" based on input from Departmental
                 elements; and

                             (c)  submission of the reports indicated in paragraph 5a(2)(b) above to
                 the Office of Management and Budget, the Council on
                 Environmental Quality, and the Environmental Protection Agency.

Suggest adding, “Include training on environmental requirements and EMSs in management training for DOE Operations/Field Office Managers, as appropriate.”  Currently there is no requirement for DOE Operations/Field Office Managers to have any training on EMS.  This comment applies to paragraph 450.1 5.(d).

            <SectionContent><![CDATA[
         b.   Program Secretarial Officers, the Administrator for the National Nuclear Security
       Administration, Administrators for Power Administrations, and DOE
       Operations/Field Office Managers must assess implementation of EMSs as a
       component of the implementation of DOE P 450.5, Line Environment, Safety and
       Health Oversight, dated 6-26-97.

         c.   Program Secretarial Officers, the Administrator for the National Nuclear Security
       Administration, and Administrators for the Power Administrations, in addition to
       the requirements in paragraph 5b, must do the following.
    
                   (1)  Ensure that by December 31, 2005, all sites under their purview have
            implemented the management system requirements of this Order.

                   (2)  Request through the annual budgetary ES&H Management Plan or other
            Departmental budgetary process the funding and resources needed for
            implementing the requirements of this Order and funding to address
            findings and recommendations from oversight and self-assessment
            activities conducted in accordance with DOE P 450.5.

                   (3)  Ensure sites under their purview include site-specific goals in all annual
            contract performance measures to contribute to the accomplishment of
            DOE P2 and energy efficiency (P2E2) goals.  (P2E2 goals are contained in
            a memorandum signed by the Secretary on November 12, 1999.)

                   (4)  Ensure sites under their purview provide to the Office of Environment,
            Safety and Health the information needed to prepare the Department's
            environmental reports pursuant to DOE M 231.1-1, Environment, Safety
            and Health Reporting Manual, dated 9-30-95.

                   (5)  Ensure sites under their purview develop and implement cost-effective P2
            programs that uses life-cycle assessment concepts and practices in
            determining program return on investment (ROI).

                   (6)  Evaluate on an annual basis P2 nominations from sites under their
            purview, select  "best in class" nominees, and transmit the nominating
            information to the Office of Environment, Safety and Health for submittal
            to the White House's  "Closing the Circle Awards" program.

                   (7)  Ensure sites under their purview monitor progress toward meeting the P2
            requirements of paragraph 4b(2) of this Order, and make such information
            available annually to the Office of Environment, Safety and Health.

                   (8)  Evaluate the effectiveness of the implementation of the requirements of
            this paragraph for sites under their purview.
