This revision to O 413.3 has not addressed the direction of the Under Secretary memo of March 31, 2003 which was "I have directed OMBE to publish revisions to DOE O 413.3, Program and Project Management for the Acquisition of Capital Assets, to make it consistent with the manual."  

This revision demonstrates the confusion that is created when there are two requirement documents for the same subject.  i.e. they are never consistent.  

Strongly encourage that all Project Management requirements be placed in one directive; logically DOE O 413.3.  In this case, the Manual could be used for guidance only.

BSO's understanding was that the next revision to O413.3 was to reconcile differences with M413.3 such that the new Order would be the governing directive to which DOE and the Labs would manage projects.  This does not appear to be the case with this revision.  Is this planned; when will it happen?  Please clarify the relationship between Order and Manual, especially regarding requirements vs. guidance.

The new order is not consistent with the Manual There are a significant number of changes that are required before the Order should be issued. OECM has had a team working on this for almost a year.  Incorporate those changes as well into this revision.  Adding a paragraph to address only safeguards and security requirements is understandable but unaceptable because of the differences between the manual and order. Comment:  Add a paragraph 8 to Chapter VII to read as follows:
8.	Counterintelligence.  Counterintelligence is an integral part of project planning and execution.  Counterintelligence goals and objectives must be considered in acquisition of capital assets in initial phase of the project and throughout each phase.  (NA-3.2/Burch)

Comment:  The directive still does not include provisions for another key program that should be a factor in program and project management for the acquisition of capital assets--emergency management.  
A provision almost identical to the proposed change for safeguards and security should be included as Chapter VII, paragraph 8:
8.	Emergency Management.  Emergency Management is an integral part of project planning and execution.  Acquisition of capital assets must address applicable emergency management requirements early in the initial phase of the project and integrate these requirements along with safety, quality, and environmental protection in every phase of the acquisition process.

Comment:  There are some inconsistencies between the revised Order and Manual M 413.3-1. Here are a few examples.  The revised Order still uses the term Federal Project Manager where the Manual introduced the term Project Director.  Approval levels and allowable delegation are not consistent between the two documents.  The revised Order still spells out Baseline Change Levels 0 through 3 whereas the Manual eliminated these levels and introduced the term “deviation.”   Since the revised Order is going to be officially released, either the Order or the Manual should be modified so the two documents are consistent. Comment:  Deputy Secretary McSlarrow issued DOE M 413.3-1 as the controlling document over DOE O 413.3, stating in the cover Memorandum for the Manual:  "Pending the update of DOE O 413.3, the manual takes precedence where there is a conflict between the processes, procedures and approval levels contained in the manual and those in the Order and other project management policy statements, ....”  This needs to be covered under this revision since conflicts between the Order and Manual still exist.
