1)  If this Order is intended to apply to defense nuclear facilities, it must have a separate finding that the order is necessary for the protection of human health and the environment or safety, the fulfillment of current legal requirements, or the conduct of critical
administrative functions, as specified in 42 USC 7274k.  Please contact ME-43 for
details.

2)  The draft does not appear to establish requirements on members of the public that necessitate a notice and comment rulemaking.  No action by the OPI is required.

3)  The directive is a "rule" as that term is defined by the Small Business Regulatory Enforcement Fairness Act of 1996, 5 U.S.C. 801-804, which requires that, when issued in final form, the directive be reported to Congress.  No action by the OPI is required.  GC will report this directive to Congress when it is issued.]]></Comments>

                  <ResponseContent><![CDATA[We believe the order is necessary exists based on direction provided by Congress to report the activities on an annual basis and several DOE IG reports which recommended and DOE concurred in to develop a set of procedural requirements and standards for overseeing and justifying contractor assignments to HQ.  A follow up DOE IG audit recently stated that the order and its requirements are sufficient to address previous IG findings and should continue to be implemented. 

OMBE will make, with the help of the commenter, a separate finding that the order is necessary for the "...the fulfillment of current legal requirements, or the conduct of critical administrative functions, as specified in 42 USC 7274k.

This is not viewed as a major issue in that the current practices would not preclude NA from meeting the requirements delineated in this order nor has a major impact on program mission and requires DOE-wide action.  If the NA organization determines this should be a NA restriction it is suggested that the restriction be implemented within NA.  Finally, there is no known requirement or prohibition to fund these assignments through the use of Administrator or Program Direction funds. The department requires for all organizations approving an assignment that each be funded and within allocated positions to that organization.  In addition, the organization must meet the requirements related to assessing the need for such an assignment and cost reasonableness.  ]]></ResponseContent>

                  <ResponseContent><![CDATA[The current order was established based upon a FY 1997 DOE-IG  audit which found DOE was unaware of the total number and costs of M&O contractor positions assigned to HQ. Assignments totaled more then 850 at the time the first data call was collected and cost were deemed excessive. Many assignment work scopes and costs were unknown to the organizations providing financial support.  The report recommended and DOE concurred that DOE should establish DOE-wide policy and procedures for the review approval and administration of M&O contractor positions assigned to the Washington D.C. area.  A DOE-wide effort, with program organization support, was undertaken which succeeded in the development of DOE O 350.2.  Annually, Congress mandates in its report language the permissible aggregate levels of assignments DOE-wide and requires a DOE annual report detailing the uses, costs, and the aggregate level of the assignments.  Finally, the DOE-IG recently conducted a follow-up review of the current policies and procedures and found that no additional recommendations were necessary and all previous recommendations had been satisfied. The follow-up report further stated that DOE should continue to apply the requirements contained in the order. Based on this the order is not deemed to be questionable as stated in the comment. Finally, the comment is not deemed to be a major issue but more of a stated position of the order and its requirements and associated actions to satisfy the requirements.  ]]></ResponseContent>

     a.   DOE Elements.  The provisions of this Order apply to all Departmental elements,
          including those within the NNSA (see attachment 1), except for those elements
          specifically exempted in paragraph 3c.

     b.   Contracts.

          (1)  The Contractor Requirements Document (CRD), Attachment 2, sets forth
               the requirements of this order which apply to M&O and other facility
               management contractors whose contract contains a Laws, Regulations and
               DOE directives contract clause.

          (2)  The CRD, when included in a contract, permits assignment of contractor
               employees to DOE Headquarters when the prescribed requirements
               delineated in this order are satisfied.
          (3)  Contracting officers are responsible for incorporating the CRD into
               appropriate M&O and other facility management contracts via the Laws,
               Regulations, and DOE directives clause of the contracts.

     c.   Exclusions.  This Order does not apply to the Bonneville Power Administration or
          the Office of the Deputy Administrator for Naval Reactors.  This Order also does
          not apply to assignments under Intergovernmental Personnel Act Mobility
          Program Agreements, Work-for-Others agreements, or such others as may be
          exempted by the Chief Financial Officer/ Director, Office of Management, Budget
          and Evaluation (OMBE), or the Headquarters personnel officer, NNSA.

However, I have revised subparagraph 3.b(5) of the template language since subparagraph 4.e. prohibits use of M&O subcontractor employees in the DC area.  Note: a contract's use of the Laws, regulations and directives clause is not an acceptable basis for instruction for when to attach the CRD for this directive to a contract.  Replace the existing language with the following:

            <SectionTitle><![CDATA[4. Requirements]]></SectionTitle>
            <SectionContent><![CDATA[<b>4.   REQUIREMENTS</b>.

     a.   The number and types of positions for DOE M&O and other facility management
          contractor employees located in the Washington, D.C., area must be within
          approved Headquarters program, site office or M&O or other facility management
          contractor staffing plan ceilings.

     b.   At the request of a Headquarters program or site office, the Head of the
          Contracting Activity (HCA) or designee may authorize DOE M&O and other
          facility management contractors to assign employees to positions in the
          Washington, D.C., area, provided those positions conform to one or more of the
          following conditions.

          (1)  Employees provide a Headquarters program or site office with technical
               expertise and experience in the Washington, D.C., area, that is critical to
               that office's operation or program(s) when that expertise and experience is
               not otherwise available at lower cost through other types of contracts (e.g.,
               support service contracts).

          (2)  Employees undertake tasks that must be performed in the Washington,
               D.C., area because staff must coordinate or interface in person with
               Headquarters staff or other agencies or because such assignments can be
               demonstrated to be cost effective for performance of the task.

          (3)  Employees provide administrative support to a M&O or other facility
               management contractor's Washington, D.C., office.  The number and
               types of administrative support staff must be based on good business
               practices and approved by the HCA or designee.

          (4)  Employees, other than administrative support staff, provide technical
               expertise within the mission and scope of work of the contract under
               which the assignments are made.

     c.   Assignment of DOE M&O and other facility management contractor employees to
          the Washington, D.C., area must not adversely affect the contractor's mission or
          otherwise adversely affect the contractor's ability to meet contract commitments.

     d.   DOE M&O and other facility management contractor employees shall not be
          assigned to the Washington, D.C., area to

          (1)  compensate for reductions in support service contracting;

          (2)  provide administrative support (e.g. clerical or para professional) within
               Federal facilities or for Federal employees;

          (3)  perform functions inherently reserved for Federal employees, including
               directly supervising Federal employees and making fiscal and/or policy
               decisions;

          (4)  perform assignments that exceed 12 months in duration unless the
               individual's continued assignment is critical and represents significant
               mutual benefit to the program sponsor and the facility;

          (5)  perform contractor business development or lobbying;

          (6)  extend support beyond the completion of the work assignments; or

          (7)  perform any function that may be construed as a personal or organizational
               conflict of interest as referenced in DEAR Subpart 909.5 or 970.0905 and
               defined in 952.209-72.

     e.   DOE M&O and other facility management contractors are not to award
          subcontracts, or subcontract work tasks, to provide direct support to program
          offices in the Washington, D.C., area.

     f.   DOE M&O and other facility management contractor employee work assignments
          performed in the Washington, D.C., area must conform to the relevant program or
          site office critical skills staffing plan or the contractor's Washington, D.C., office
          staffing plan.  The process required for establishing staffing requirements (see
          Attachment 3) is as follows.

          (1)  Each Headquarters program or site office that uses M&O and other facility
               management contractor employees within the Washington, D.C., area will
               submit, by May 1, an annual critical skills staffing plan (see Attachment 4)
               to the Director, OMBE, or Headquarters personnel officer, NNSA, as
               appropriate.   Site office plans must be approved and forwarded through
               the HCA and the Cognizant Secretarial Officer (CSO).  These plans should
               list the employees who provide direct support to program organizations
               sponsoring the assignments.  Plans are required to;

               (a)  delineate the name and the job description including the required
                    skills and expertise to be provided by each contractor employee
                    who will be reimbursed with Departmental funds,

               (b)  include a proposed ceiling for the number of contractor staff to be
                    assigned during the next fiscal year,

               (c)  provide total estimated monthly cost (including all indirect costs)
                    for each assignment,

               (d)  detail the percentage of time charged for each assignment to a
                    Headquarters program organization(s).  If an assignment supports
                    more then one program office, the plan should indicate the
                    percentage of support provided to each program with the aggregate
                    total equaling 100 percent,

               (e)  identify the facility providing the employee, and

               (f)  include estimated start and end dates for each assignment,

               (g)  include the site location for each assignment

               (h)  identify the program being supported (e.g. basic energy science).

          (2)  If the HCA or designee determines a M&O or other facility management
               contractor may establish a Washington, D.C., staff office, the HCA or
               designee will develop and submit through the CSO an
               administrative/overhead staffing plan (see Attachment 5) to the Director,
               OMBE, or Headquarters personnel officer, NNSA, as appropriate.  The
               plan is to be submitted by April 1 and list contractor employees
               performing work for the M&O or other facility management contractor's
               Washington D.C., office.  M&O and other facility management contractor
               staffing plans are required to;

               (a)  delineate the following positions that are located at the contractor's
                    Washington office and the costs of which are reimbursed by the
                    Department including;

                    1    all administrative, office support, and overhead positions
                         and

                    2    any positions that ensure efficient task performance but do
                         not support specific program offices.

               (b)  The plan will also indicate the program account each assignment is
                    charged against and the proposed staffing ceiling for the next fiscal
                    year.

          (3)  The Director, OMBE, or the Headquarters personnel officer, NNSA, as
               appropriate, will consult with affected organizations to establish ceiling
               numbers for each Headquarters program, site, and contractor staff office
               based on the total number of assignments requested via staffing plans and
               Congressional report language which limits the total number of
               assignments permitted DOE-wide.  The ceilings are to be approved by the
               Deputy Secretary, DOE, with concurrence by the Director, OMBE, or the
               Headquarters personnel officer, NNSA, as appropriate, by August 1 of
               each year.  NNSA Headquarters personnel officer and OMBE will
               distribute approved allocation notifications to appropriate offices.

               (a)  DOE program and site offices are responsible for meeting the
                    criteria for assignments and for remaining within approved staffing
                    plan ceilings.

               (b)  Each M&O and other facility management contractor must operate
                    within its approved staffing plan ceiling.

     g.   Any DOE Headquarters program, site, or contractor staff office facing a critical
          need to exceed its ceiling may request a waiver from the Deputy Secretary, DOE.
          All waiver requests must be concurred in by the Director, OMBE, before
          submission to the Deputy Secretary, DOE.  For requests from NNSA
          organizations, concurrence of the Headquarters personnel officer, NNSA, is also
          required.  The request must include the following information;

          (1)  justification for modifying the staffing plan and a list of the critical work
               task(s) that can not be performed by currently assigned contractor
               employees,

          (2)  the start and end dates for the work assignments requiring the waiver,

          (3)  the organizational subcomponent (or other organization or contractor) to
               which the employee will provide services,

          (4)  the physical location of the facility contractor employee assignments, and

          (5)  an explanation of how the facility contractor employee assignments are
               cost effective.

     h.   All assignments of M&O and other facility management contractor employees to
          the Washington, D.C., area require the authorization of the HCA or designee.
          Procedures for approving assignments these employees in the Washington, D.C.,
          area must, at a minimum, meet the requirements of this order and DOE's Work
          Authorization Process.  The required procedures (illustrated in Attachment 6)
          must include the following.

          (1)  The DOE Headquarters program or site office, in concert with the M&O or
               other facility management contractor and the DOE HCA or designee,
               develops a work authorization statement showing the required skills mix,
               scope of work, estimated duration of assignments/needs, reporting
               requirements, funding source, and any other information required for a
               work authorization.

          (2)  The DOE Headquarters program or site office must certify that
               Washington, D.C., employee assignments conform with its staffing plan
               and are within its ceiling allocation.

          (3)  The contractor informs the cognizant DOE contracting officer or designee
               of the personnel qualified and available to be assigned.

          (4)  The DOE contracting officer or designee examines the work authorization
               statement to ensure assignments will not adversely affect the M&O or
               other facility management contractor's performance.  The DOE
               contracting officer or designee or the Headquarters program organization
               will update the database that has been established to maintain a current
               inventory of assignments in the Washington, D.C., area.

     i.   The DOE contracting officer or designee or the Headquarters program office,
          contingent on the approval by the HCA or the HCA's designee of a new employee
          assignment to the Washington, D.C., area or upon the expiration of an existing
          assignment, enters the appropriate changes into the OMBE M&O and other
          facility management contractor employee database, within 30 days of such change
          becoming effective.

(3)	Administrative support to an M&O in the Washington area should be included in the contractorâ€™s staffing plan to be approved by the responsible Head of Contracting Activity and the Cognizant Secretarial Organization.  Contractor staffs in the Washington area are to share consolidated space.  The need for each contractor to have support staff should be reviewed from the broader perspective of cost effectiveness.  At one time these services were to be provided by local administrative staffing agencies.  It is recommended that a cost benefit analysis be required prior to approval of administrative staffing positions.

d. (4)	The necessity for assignments exceeding 12 months should be carefully reviewed.  The purpose of field contractor support in the Washington area should be limited to specialized expertise not generally available through other contracts.  A justification for continued need should be provided with the staffing plan.

f. (2)    The Department has worked extremely hard to reduce the assignments and space required for M&O or other facility management contractors in the Washington area.  This paragraph seems to imply that the M&Os or other facility management contractors are at liberty to identify and obtain space.  In the past, consolidated space has been arranged for the administrative office in the Washington area.  Is the intent of this paragraph to permit additional offices to be opened?  The establishment of an office should be coordinated with the Lead Program Secretarial Officer (LPSO) or Cognizant Secretarial Officer (CSO) organization, not just the staffing plan.  

This paragraph contains a due date of April 1, whereas paragraph f(1) indicates a due date of May 1.  It is suggested that the field contractor staffing plan and the Headquarters staffing plans be submitted as one package by the CSO.

f. (2)(a)2  States that the contractor staffing plan should include positions that ensure efficient task performance but do not support specific program offices.  It is not clear why we would authorize these types of support positions when we are attempting to streamline and reduce the presence of field contractors in the Washington area.

                  <ResponseContent><![CDATA[Taking the comments in order as there are several being submitted within this write-up;

b.3 Changes to the order now require the M&O contractor to submit to the HCA a support plan for establishing or continuing the staffing of a Washington D.C. office. Following that, the HCA is required to submit the plan through the CSO's office to the Director OMBE, or headquarters personnel officer by May 1st. The plan if agreed to by the HCA and the CSO will be considered as part of the allocation of DOE-wide allocations see REQUIREMENTS 4.f.(2).  While not institutionally required throughout DOE, a cost benefits analysis can be used as part of the HCA and/or CSO determination prior to submitting for S-2 approval. 


d.4. The need for careful consideration for continuing each  assignment by the responsible sponsoring office is advisable. Justifications for each sponsored assignment by the sponsoring organization would be helpful for the HCA sponsoring organization and CSO toward determining the validity of an assignment however, to require its inclusion in the staffing plan should not be mandated by the OPI for the order. This primary responsibility for ensuring assignment is necessary rests with the sponsoring organization. Sponsoring offices can mandate these justifications prior to agreeing to fund an assignment for the following fiscal year. OMBE and the Headquarters personnel officer are not in a position to assess these assignments against program goals and objectives of the sponsoring organization. Clearly program organizations providing the funding would not want either OMBE or Headquarters personnel officer questioning their expenditure of funds for assignments.. The current practice of validation through the HCA and sponsoring organization and input from the CSO appears more then adequate and appropriate. 

f.2. See previous response where it is made clear the HCA/CSO are actively involved in the process permitting offices to be established.

The 4/1 and 5/1 dates which have been revised to 5/1 and 7/1 are contained in the order to permit the submission of contractor plans to CSO offices to be considered as part of an overall assessment of assignments being endorsed by a sponsoring and CSO offices. CSO offices are clearly identified as part of the approval chain for contractor staff offices in Washington D.C. 

f.2(A)2 The CSO and sponsoring organizations should carefully consider these types of positions when endorsing and forwarding for approval.

4.d (6) While it is agreed that the term of the assignment should be defined and carefully managed, ultimately, the management of assignments and determining when those assignments should be terminated is at the discretion of the funding organization. It is unclear why the suggested requirement, determined to be beneficial towards improving the administration of positions within the commenting organization, has not been implemented within the organization.  It should be noted that Section 4 (Requirements) requires for each assignment that the HCA, Sponsoring organization and the contractor providing the personnel address cost, scope and duration of assignment.  In performing these actions it is expected that organizational internal procedures would require the development of any documentation deemed necessary as part of its standard process. This would include a clear indication of the length of assignment at HQ.  

4.f.(1) As part of an initial distribution of assignment positions during FY 1997 when DOE was attempting to ensure proper management of assignments,  it was determined that several individual assignments were being supported by multiple organizations. Percentage of support for one individual could be provided by 3 separate program organizations.  It was decided that those positions would be assigned to the responsible office (the office which supplies the staff).  This was done to complete the first phase of the improvement effort to mange headquarters assignments.  Additionally, a limited number of site offices have approved a small contractor office to be located in the Washington D.C. area. These offices, with few assignees are supporting one or more contractor sites and their assignees.  Having said this, OMBE plans to discuss the issue of field allocated positions, which are requested and submitted via site office request, during FY 2004.  The goal will be to move allocation and control of as many positions as possible from the field locations to their respective program organizations.   While the comment does raise an important issue, changes to the allocations and reassignment of positions with the associated staff will not require a change to the order. However, the review may result in a definitive position that supports some (few in number) to be overseen and requested via field submissions. 

4.f.(2)	There is no support nor intent for additional space to be provided within Washington D.C.   The HCAs are accountable to their respective CSOs and required to submit such plans to the CSOs for endorsement. In addition those plans are to be submitted to the Headquarters personnel officer NNSA and /or OMBE. Included in these plans per attachment 5 would be a description of the additional costs for maintaining the office in Washington D.C. OMBE and the Office of the Headquarters personnel officer NNSA are well aware of the sensitivity related to increasing office space.  Finally, any plan which proposes the above would be required to have the Headquarters personnel office NNSA and/or OMBE support to be considered for approval by the Deputy Secretary DOE. Subparagraph 4.b, has been revised and now states that all technical positions assigned to HQ program office meet the following criteria:  1) Contractor employees provide a Headquarters program or site office with technical expertise and experience in the Washington, D.C., area, that is critical to that office’s operation or program(s) when that expertise and experience is neither available within the program or site office nor at lower cost through other types of contracts (e.g., support service contracts); 2) Contractor employees undertake tasks that must be performed in the Washington, D.C., area because staff must coordinate or interface in person with Headquarters staff or other agencies or because such assignments can be demonstrated to be cost effective for performance of the task; and 3) Contractor employees, other than administrative\overhead support staff, provide technical expertise within the mission and scope of work of the contract under which the assignments are made. 

These requirements apply to ensure factors mentioned in the comment, e.g., alternative sources for the support or in cases where the M&O employee is required other more cost effective assignment options are considered prior to approving any assignment.  Organizations providing funding and approval for assignment(s) must be in a position to justify any assignment both in terms of cost and necessity. Justification for costs should be developed by the sponsoring organization however, this OPI believes that the requirement to address costs and what alternatives to consider is at the discretion of the funding organization.  To impose any other specific set of criteria and methodology assumes the OPI would know the best practices for each organization. The OPI prefers to leave this judgment to the funding organization.

5.a.  A statement is needed to indicate that the DOE Headquarters program element will review and approve:  Headquarters program staffing plans, Field staffing plans and requirements for space in the Washington area.

5a(5).  It is not clear why each program organization would need to establish procedures for these types of assignments.  The requirements are contained in the Order.

5(a)6.  Clarification is needed on inventory requirements.  Is it the expectation the each program organization will maintain an inventory independent of the Departmentâ€™s contractor database?  If so, it is not clear why this would be required when other provisions of the order required updates to the Departmental system to be made within 30 days.

5.b.  DOE Heads of Contracting Activity

5.b.(1)  requires the HCA to submit for an office staffing plan â€œas needed.â€  These requirements are submitted annually.  Is the intent of this statement that changes needed outside of the annual staffing plan need approval or is the intent of the statement to submit the annual plan only if field contractors will be assigned to Washington?

5b.(3).  Suggest adding language to indicate that work authorizations for Washington assignments must be â€œwithin established ceiling allocations.â€

5.b(4).  See previous comment on inventory requirements.  Is the HCA to maintain a separate inventory independent of the Departmentâ€™s database?

5.b(5).  It is not clear how the HCA is to review the contractorâ€™s use of leased space.  Clarification is needed.  Is this to be a part of the review annual staffing requirement?]]></Comments>
