If the CRD is eliminated, this Order would only address internal agency management.  The draft would appear to establish requirements on members of the public that necessitate a notice and comment rulemaking.  If the CRD is eliminated, no additional action the OPI would be required.

                  <ResponseContent><![CDATA[DUARTE [Reject]: The CRD does not establish requirements on members of the public.  It establishes requirements for contractors.  The Department may impose such requirements as part of the contracting process.

FULLERTON [Reject]: As of this time, the Directives has issued only a preliminary, recommended desicion.  The Office of Economic Impact and Diversity has submitted a response.  A final decision is pending.

The CRD strengthens and clarifies each contractor’s responsibility to ensure equally employment opportunity, and to foster diversity among its workforce.  The clear intent of this clause is to require DOE contractors to comply with the spirit – if not the letter -- of the Department of Energy’s various mandates on EEO and diversity, many of which exceed legal and regulatory requirements, or which serve to clarify those requirements.

Examples of recent such mandates by the Secretary include (but are not limited to) the Policy Statement Against Racial Profiling (April 16, 2001), and the Department of Energy EEO and Diversity Policy Statement (October 31, 2001).  Each of these documents mandates EEO and diversity requirements for the Department that exceed legal and regulatory requirements.  Through the CRD, DOE encourages contractors to meet the Department’s higher standards for EEO and diversity, and to become model employers for their 100,000+ employees.  
 
In point of fact, outside of the CRD there exists no independent legal, regulatory or contractual requirement for contractors to enhance their workforce diversity.  (While EEO is a legal requirement, diversity is not.)  Accordingly, absent the CRD’s mandate to strive to enhance workforce diversity, contractors would be free to disregard the issue altogether, a result which would be antithetical to the Secretary’s stated commitment to diversity.

With respect to equal employment opportunity, contractors are bound by specific legal and regulatory requirements.  The Office of Economic Impact and Diversity (ED), in conjunction with the Department of Labor’s Office of Federal Contract Compliance Programs, is charged with oversight of contractor compliance.  The CRD serves as the mechanism that enables ED to fulfill its mandate. Through the CRD, ED can request relevant EEO and diversity information from contractors, analyze the information, and prepare reports to the Secretary.

Furthermore, eliminating the CRD would be contrary to the recommendations contained in a recent report by the General Accounting Office, “DOE Weapons Laboratories: Actions Needed to Strengthen EEO Oversight” (GAO-02-391), which states that the Department should take steps to strengthen its oversight of contractor EEO compliance.  In its report, the GAO recommends that the Secretary of Energy work more closely with the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) to determine EEO problems at weapons laboratories, and then take appropriate action to correct those problems.

In a written response to GAO, the Department agreed to implement the recommendation.  To do so, however, the Department must rely on such tools as the CRD to obtain relevant information from DOE contractors.  Absent the CRD, our efforts to fully implement the Department’s oversight responsibilities and the GAO recommendation will be severely hampered. 

The Director of ED has been charged with responsibility for establishing EEO and diversity policy for the Department.  In that capacity, the Director has authority to establish requirements for contractors which allow ED to fulfill its legal mandate of oversight of contractor EEO and diversity compliance.  

The CRD remains the Department’s primary tool for monitoring contractor EEO and diversity compliance.  It provides an avenue for the Department to request contractor data, reports and information regarding EEO and diversity issues.  Accordingly, it has been retained in the new Order.  However, both the  Contractor Responsibilities section and the CRD have been substantially revised in accordance with comments received.

3) Striving to meet DOE expectations regarding contractor commitments to
Diversity are no longer required per the CRD; the previous CRD contained
specific reference to Diversity. This draft version does not. 
I was confused by the CRD reference to 311.1X as 'required for contractors'
in that the main body of 311.1X references DOE 'Elements' and 'the
Department'. 
I do not see additional burden for the Laboratories, to the extent that my
reading of the Order, as described above, is correct. And, while I've noted
the 'loss' of the emphasis on Diversity, that commitment is one that SNL continues to have.

(4) The office identified in the Responsibilities paragraph is responsible for notifying the contracting officer of which site/facility management contracts are affected.  Once notified, the contracting officer is responsible for incorporating the CRD into each affected site/facility management contract via the Laws, regulations, and DOE directives clause of the contract.

(5) Flow down requirements are dictated by the contract clause.

Responsibilities. 

[in this paragraph, the OPI must identify an office as responsible for ensuring the CRD is incorporated into each affected site/facility management contract and task that official with  telling the contracting officer of each affected site/facility management contract.

If the OPI has indicated that  the CRD is to apply to only certain types of work within a contract, the OPI must task the office identified with telling the contracting officer which work is affected. 

Here also the OPI must articulate what authority  is granted to the office  identified to modify the CRD.

In this paragraph, the OPI must task the contracting officer, after he or she has been notified, with incorporating the CRD into the affected site/facility management contract via the laws, regulations, and doe directives clause of the contract.

If it is appropriate, the OPI may ask the NNSA and DOE Director OPMA to work with the OPI to develop, publish for public comment, and incorporate into the NNSA & DOE acquisition regulation any required contract clause and clause prescription that should be inserted in other than site/facility management contracts.]

This Order cannot be binding on recipients of financial assistance without going through public rule making. There is no "Laws and directives" clause in financial assistance agreements and certainly it cannot be binding on applicants without a solicitation provision.


CRD:

1. Rewrite to specify what exactly in DOE O 311.1X the contractor must comply with.  

2. Subcontract flow down must be specified in a contract clause.

3. Delete the "and all other applilcable rules, regulations, ... "  language. They must be specified.

4. Executive Orders do not impose contract clauses on contractors. Eos must be implemented through the rule making process. Contractors then comply with the final rule.

     2.   CANCELLATION.  DOE O 311.1A, Equal Employment Opportunity and Diversity
     Program, dated 12-30-96.  Cancellation of an Order does not, by itself, modify or

     incorporated by reference in a contract must remain in effect until the contract is

     3.   APPLICABILITY.

               a.   DOE Elements.  This Order applies to all DOE elements, including the National

The clear intent of this clause is to require DOE contractors to comply with the spirit – if not the letter -- of the Department of Energy’s various mandates on EEO and diversity, many of which exceed legal and regulatory requirements, or which serve to clarify those requirements.

Examples of recent such mandates by the Secretary include (but are not limited to) the Policy Statement Against Racial Profiling (April 16, 2001), and the Department of Energy EEO and Diversity Policy Statement (October 31, 2001).  Each of these documents mandates EEO and diversity requirements for the Department that exceed legal and regulatory requirements.  Through the CRD, DOE encourages contractors to meet the Department’s higher standards for EEO and diversity, and to become model employers for their 100,000+ employees.  
 
In point of fact, outside of the CRD there exists no independent legal, regulatory or contractual requirement for contractors to enhance their workforce diversity.  (While EEO is a legal requirement, diversity is not.)  Accordingly, absent the CRD’s mandate to strive to enhance workforce diversity, contractors would be free to disregard the issue altogether, a result which would be antithetical to the Secretary’s stated commitment to diversity.

With respect to equal employment opportunity, contractors are bound by specific legal and regulatory requirements.  The Office of Economic Impact and Diversity (ED), in conjunction with the Department of Labor’s Office of Federal Contract Compliance Programs, is charged with oversight of contractor compliance.  The CRD serves as the mechanism that enables ED to fulfill its mandate. Through the CRD, ED can request relevant EEO and diversity information from contractors, analyze the information, and prepare reports to the Secretary.

Furthermore, eliminating the CRD would be contrary to the recommendations contained in a recent report by the General Accounting Office, “DOE Weapons Laboratories: Actions Needed to Strengthen EEO Oversight” (GAO-02-391), which states that the Department should take steps to strengthen its oversight of contractor EEO compliance.  In its report, the GAO recommends that the Secretary of Energy work more closely with the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) to determine EEO problems at weapons laboratories, and then take appropriate action to correct those problems.

In a written response to GAO, the Department agreed to implement the recommendation.  To do so, however, the Department must rely on such tools as the CRD to obtain relevant information from DOE contractors.  Absent the CRD, our efforts to fully implement the Department’s oversight responsibilities and the GAO recommendation will be severely hampered. 

The Director of ED has been charged with responsibility for establishing EEO and diversity policy for the Department.  In that capacity, the Director has authority to establish requirements for contractors which allow ED to fulfill its legal mandate of oversight of contractor EEO and diversity compliance.  

The CRD remains the Department’s primary tool for monitoring contractor EEO and diversity compliance.  It provides an avenue for the Department to request contractor data, reports and information regarding EEO and diversity issues.  Accordingly, it has been retained in the new Order.      4.   REQUIREMENTS.

               a.   Heads of DOE elements must submit reports when requested by the Director,
          Office of Economic Impact and Diversity or the Director for Civil Rights and
          Diversity or their designees.

               b.   DOE elements with EEO complaint processing functions must interface with the
          Office of Economic Impact and Diversity's Complaint Tracking System by
          updating their respective cases and those cases which have been assigned to them
          from Headquarters (HQ) or other field elements.  Users will have limited access
          to any site to which they are not authorized.

               c.   All employees must participate in annual EEO/diversity training, and supervisors
          must have had such training before (or within an appropriate time period
          following) appointments to supervisory positions.

               d.   All employees within the Department are responsible for ensuring the Department
          is free from discrimination on the basis of race, color, religion, sex (including
          sexual harassment), national origin, reprisal, age, physical or mental disability, or
          sexual orientation (including sexual orientation harassment).

               e.   All employees within the Department must participate in biennial training on the
          prevention of sexual harassment.  This training does not substitute or replace the
          annual training on EEO/diversity (paragraph 4c.)

               f.   Each applicant for Federal financial assistance must complete a DOE F 1600.5,
          "Assurance of Compliance Nondiscrimination in Federally Assisted Programs,"
          which incorporates the requirements of all applicable civil rights laws, and each
          recipient of Federal financial assistance maintaining an ongoing relationship with
          the Department must submit an annual compliance certification.

Paragraph 4.f. imposes an unacceptable reporting burden on recipients in violation of OMB paperwork reduction requirements. This requirement for annual reporting is burdensome and unnecessary for recipients who maintain an ongoing relationship with DOE. In the acquisition arena, contractors are only required to provide EEO compliance clearances for projects over $10 million dollars and it is valid for the entire contract period. Based on the requirement of this order, Financial assistance recipients will have to file for $1 and annually thereafter. In addition, there is no evidence or history of non-compliance to require annual certification. In the past ten years no recipient has been found wanting in the compliance area.

The DOE F 1600.5 is expiring in a few months.  This form collects information that does not relate to the types of grants DOE awards.  No other federal agency collects this information.  For the time being,  DOE should use the SF 424B ASSURANCES - NON-CONSTRUCTION PROGRAMS, which is the Government-wide form that has been approved by OMB for financial assistance awards.  By October 2003, recipients will be submitting their applications electronically via the Government-wide  E-Grants portal.  An assurance of non-discrimination is one of the core data elements in the electronic application..  In the near future, OMB intends to mandate a single approach for addressing national policy issues in Federal financial assistance and DOE will have to comply with this direction.  An assurance of non-discrimination is just one of many national policy issues.  It should not be treated differently than other assurances, such as those required by the National Environmental Policy Act, the Laboratory Animal Welfare Act, the law  regarding the protection of human subjects, etc.]

            <SectionTitle><![CDATA[5. Responsibilities]]></SectionTitle>
            <SectionContent><![CDATA[
     5.   RESPONSIBILITIES.

               a.   The following DOE officials are hereby designated as appropriate officials with
          whom to file an individual or class complaint of discrimination and must ensure
          any complaint received is promptly forwarded to appropriate personnel for
          processing:

                         (1)  Secretary of Energy (or his/her designee);

                         (2)  Director, Office of Economic Impact and Diversity (or designee);

                         (3)  Director, Office of Civil Rights and Diversity (or designee);

                         (4)  heads of field elements (or designees); and

                         (5)  field element EEO/diversity program managers.

               b.   Director, Office of Economic Impact and Diversity.

                         (1)  Sets EEO policy.

                         (2)  Receives complaints of discrimination and forwards them to appropriate
               personnel for processing.

                         (3)  Ensures EEO and diversity programs within the Department conform to
               established laws, rules, regulations, policies, and procedures.

               c.   Director, Office of Civil Rights and Diversity.

                         (1)  Serves as the principal advisor to the Director, Office of Economic Impact
               and Diversity, and all DOE elements, providing technical oversight of the
               Department's EEO/diversity programs.

                         (2)  Serves as the HQ EEO officer.

                         (3)  Designates special emphasis program managers and HQ EEO
               coordinators.

                         (4)  Establishes HQ equal employment opportunity or special emphasis
               advisory committees as needed, and recruits representatives from
               throughout DOE to assist in the recruitment, development, advancement,
               and retention of minorities, women, and people with disabilities.

                         (5)  Processes complaints of discrimination, including delegating the
               processing of such complaints to individual field element EEO/diversity
               managers to ensure timely, fair, and impartial consideration; investigation;
               and disposition.

                         (6)  Implements and monitors the Department's procedures for processing
               complaints of sexual orientation discrimination (including sexual
               orientation harassment) in accordance with the Department's policies
               prohibiting such discrimination.

                         (7)  Conducts (or oversees the conduct of) preaward reviews of all applicants
               and postaward compliance reviews of selected recipients of Federal
               financial assistance, and undertakes compliance negotiations when a
               recipient is not in compliance with applicable civil rights laws, rules,
               regulations, policies, or procedures.

                         (8)  Ensures allegations of discrimination in Federally assisted programs are
               investigated promptly and thoroughly by the EEO/diversity program
               office or industrial relations office (where one exists).

               d.   Headquarters Diversity Managers/EEO Coordinators will perform EEO and
          Diversity duties in accordance with the provisions of this DOE Order.

               e.   Field Element EEO and Diversity Program Managers.

                         (1)  Manage the daily functions of field organization EEO and diversity
               programs, reporting directly to the head of their respective field elements.

                         (2)  Process complaints of discrimination through the investigation stage to
               ensure timely, fair, and impartial consideration, investigation, and
               disposition.

                         (3)  Perform EEO and diversity duties in accordance with policy guidance and
               direction from the Director, Office of Economic Impact and Diversity and
               the Director, Office of Civil Rights and Diversity.
