(1) Chapter IV-5 contains the requirement that sites use and connect to the National Atmospheric Release Advisory Center (NARAC) as the primary source of consequence information.  This may be appropriate for defense nuclear facilities but should not be mandated thnroughout the DOE complex.  This requirement should be tailored to a site based on hazards and risks, as well as cost of implementation.  Sites have already adopted comparable models to NARAC using CHARM, ALOHA, etc., and no provision is made to exclude them from this provision.  The requirement should either be dropped or revised to apply only to DOE nuclear facilities/sites.

(2)  Oil is stated to not be a hazardous material in this draft order, consistent with the existing order.  Apparently confusion exists within the Department as to whether the term "oil" includes any associated constituents in the oil or just the petroleum hydrocarbons themselves.  To avoid this confusion in the future, we request that Page 5, section  14 be changed so that the sentence reads:  "For oilfield and oil storage facilities, crude oil and its constituents, petroleum condensate, and produced fluids are not included in the definition of hazardous materials."]]></Comments>

                  <ResponseContent><![CDATA[(1) - Not Accepted.  These requirements are aimed at more than nuclear facilities.  NARAC serves as the consequence assessment support for the Headquarters Emergency Management Team.  DOE N 153.2 was published to require connectivity with NARAC, so that there was a consistent source of consequence assessment information across DOE.

This requirement states that using NARAC as the primary source of consequence assessment information is one option at the facility/site level, just as the existing requirements in DOE N 153.2.  Both DOE N 153.2 and this requirement state that NARAC can be used as a back up to the primary method (such as site models like CHARM, ALOHA, etc.), the primary source when the capabilities of the site method are exceeded, or as a source of corroborating or confirming information.

(2)  Accept with Modification.   This Order, as well as its predecessor, use the definition of oil as defined in 33 USC 1321, is "oil of any kind or in any form, including, but not limited to, petroleum, fuel oil, sludge, oil refuse, and oil mixed with wastes other than dredged spoil."  Consistent with Federal law, oil is not included in the definition of hazardous materials used in this Order.

1) the Draft DOE Order 151.1X seems to ignore the fact that DOE already has a DOE Order 231.1A, Environmental, Safety, and Health Reporting - that covers most of what the Draft DOE Order 151.1X seems to want reported. DOE Order 231.1A encompasses 1) Operational Emergencies, 2) Personnel Safety, 3) Nuclear Safety Basis  4) Facility Status, 5) Environmental, 6) Contamination/Radiation Control, 7) Nuclear Explosive Safety, 8) Transportation, 9) Noncompliance Notification, and 10) Management Concerns/Issues. I think that this already pretty much covers all of the issues outlined in DOE O 151.1X.
	Draft DOE Order 151.1X has a lot of good thoughts i.e. training, annual exercises, evaluation every 3 years, etc. that are not encompassed in DOE Order 231.1A, but it would be great if somehow we
could avoid any duplicate reporting requirements.]]></Comments>

Comment:  General Comment - Overall this order provides a lot of valuable functional details, accordingly, it reads more like a manual or procedural guide than an order.  Such a significant change in format and structure to break out those parts that are better suited in an order versus manual could significantly delay the implementation of this system.  However, if the intent of this order is to use it as a procedural guide, the addition of a flow chart/matrix of the sequencing of actions is recommended to expedite execution while maintaining continuity amongst the various programs.  A diagram/matrix for information flow is also highly recommended.  This diagram should include a critical path to Counterintelligence if a foreign nexus is discovered or suspected. Comment:  Without prior supporting guidance, the draft will create wrong work approaches and imprudent expenditure of resources. It will also decrease response capabilities for minor events in favor of generic audits, evaluations and metrics focusing on readiness for major events.  This is clearly the antithesis of the hoped-for graded approach and contrary to a major lesson learned in the post-TMI era.  The draft needs a substantial definitions section.  The lack of specificity and use of subjective words and phrases such as â€œsmall fraction,â€ â€œreliable,â€ â€œeffectiveâ€ and â€œtimelyâ€ create inconsistent evaluation and conflicting opinions by auditors and reviewers.  According to one of our evaluators - they arenâ€™t responsible for our being â€œwhipsawedâ€ by ambiguous requirements and widely divergent overseer opinions.  The inclusion of bio hazards in classifiable OEs will compound the calculational, risk and susceptibility discrepancies created by combining rad and chem haz mat.  Bio hazard transport/vectors, risks, disparities between weaponized applications and epidemics, and quantitative analyses are not well enough known in complex EM to simply combine bio with chem and rad without much more study and consensus. In the interim, we could consider an OE not requiring further classification for bio issues, similar to security or mass casualty events since that is probably what they are or will become.  There are unmarked issues in the draft that remain unresolved.  The major issue is the â€œall-emergency management conceptâ€ at 1.c of the cover page.  The level of scrutiny for rad hazards far exceeds the more prevalent hazards such as fire and there is virtually no coverage for other hazards.  This belies the graded approach.  If a one-size-fits-all approach is the goal, we suggest that individual hazards be dealt with in separate guidance documents supporting a generic overarching standard. This would mitigate the technology and opinion controversies that will be created by direct inclusion of bio hazards and clearly delineate the sources of requirements beyond DOE Orders such as 29CFR. Comment:  One of the most recent IG reports addressed the subject of Continuity of Operations and was assigned to Emergency Management at the DOE level.  There are very few requirements in the draft Order dealing with the findings of that IG report.  Since this appears to be a major topic, there should be requirements in this Order for both DOE/NNSA and the Contractors as to the requirements for Continuity of Operations Plans (COOP).  There needs to be a definition section for the Order similar to those provided in other directives.  Terms such as site, facility, site/facility managers, facility managers, toxic, extraordinarily high toxicity, dispersible, laboratory scale, reactivity, ERPG, TEEL, PAG, real-time consequence assessment, and hazardous materials need to be defined.  NOTE: at some sites the term facility managers has a completely different connotation than what is desired in this Order. May want to consider including an acronym list as well to clarify to what the acronyms throughout the document relate. Throughout the document the word 'all' is used. Request these instances be removed from the document.  This only gives license for auditors to find one item and then there is a non-compliance finding with the order.  For example, screening must be done to identify all hazardous materials. If an auditor finds even one item that is hazardous, regardless of the quantity (for example white-out used by the secretaries), the site is non-compliant with the Order. Livermore General Comment 3 - Accept with Modification.  The Order has been changed to include events involving biological hazardous materials and toxins as an Operational Emergency not requiring further classification.  EPHAs will be required for certain biological hazardous materials and toxins.  

Livermore General Comment 4 - Not Accepted. The unmarked portions of this Order are requirements that have been in place since 1995.  Radiological hazards are not subjected to greater scrutiny than chemical hazards.  In this change, hazardous biological agents and toxins hazards are given the same level of scrutiny.  The existing DOE G 151.1-1 has separate sections addressing radiological and chemical hazards.  Biological hazards will be added to DOE G 151.1-1 after this Order change is completed.  The prevalent hazard of fires is the subject of worker safety requirements, addressed in DOE O 440.1.  

Los Alamos General Comment 1 - Accept with Modification. The Office of Security and Safety Performance Assurance has the responsibility to promulgate requirements for Continuity of Operations Programs.  They are preparing a draft Notice containing the requirements.

Such a glossary, as an appendix or attachment, would require a relatively small effort, but it would be worth it in terms of clarifying unambiguously what is intended in the Order. One of the most recent IG reports addressed the subject of Continuity of Operations and was assigned to Emergency Management at the DOE level.  There are very few requirements in the draft Order dealing with the findings of that IG report.  Since this appears to be a major topic, there should be requirements in this Order for both DOE/NNSA and the Contractors as to the requirements for Continuity of Operations Plans (COOP).   

There needs to be a definition  section for the Order similar to those provided in other directives.  Terms such as site, facility, site/facility managers, facility managers, toxic, extraordinarily high toxicity, dispersible, laboratory scale, reactivity, ERPG, TEEL, PAG, real-time consequence assessment, and hazardous materials need to be defined. May want to consider including an acronym list as well to clarify to what the acronyms throughout the document relate.

1.	OBJECTIVES.

a.	To establish policy and to assign and describe roles and responsibilities for the 
Department of Energy (DOE) Emergency Management System.  The Emergency 
Management System provides the framework for development, coordination, 
control, and direction of all emergency planning, preparedness, readiness 
assurance, response, and recovery actions.  The Emergency Management System 
applies to DOE and to the National Nuclear Security Administration (NNSA).

b.	To establish requirements for comprehensive planning, preparedness, response, 
and recovery activities of emergency management programs or for organizations

included in all site/facility management contracts associated with the 
management and operation of DOE-/NNSA-owned facilities and 
associated transportation activities

(3)	The CRD does not automatically apply to other than site/facility 
management contracts.  Any application of the CDR to other than 
site/facility management contracts will be communicated by issuance in 
the DOE Acquisition Regulations or through the regulatory process.

(4)	The office identified in Chapter I, Responsibilities, is responsible for 
notifying the contracting officer of which site/facility management 
contracts are affected.  Once notified, the contracting officer is responsible 
for incorporating the CRD as a List B directive into each affected 
site/facility management contract via the laws, regulations, and DOE 
directives clause of the contract.

(5)	As the laws, regulations, and DOE directives clause of a site/facility 
management contract states, regardless of the performer of the work, the 
site/facility management contractor with the CRD incorporated into its 
contract is responsible for compliance with the requirements of the CRD.  
An affected site/facility management contractor is responsible for flowing 
down the requirements of this CRD to subcontracts at any tier to the extent 
necessary to ensure the site/facility management contractors compliance 
with the requirements.  In doing so, the contractor must not unnecessarily 
or imprudently flow down requirements to subcontracts.  That is, the 
contractor must (1) ensure that it and its subcontractors comply with the 
requirements of this CRD to the extent necessary to ensure the contractors 
compliance, and (2) only incur costs that would be incurred by a prudent 
person in the conduct of competitive business.

c.	Exclusions.

(1)	The facilities and activities of the Naval Nuclear Propulsion Program and 
the Power Marketing Administrations are exempt from the requirements of 
this Order.

(2)	All DOE/NNSA facilities subject to Nuclear Regulatory Commission 
(NRC) license requirements are specifically exempted from the 
requirements of this Order.

(3)	If a DOE/NNSA element or contractor can demonstrate that it is subject to 
emergency management program requirements under the authority of other 
Federal regulatory agencies and those requirements are at least as stringent 
as the requirements of this Order, then an exemption may be requested.

Emergency Management System to ensure that

(a)	the Department can respond effectively and efficiently to 
Operational Emergencies and Energy Emergencies and can provide 
Emergency Assistance so that appropriate response measures are 
taken to protect workers, the public, the environment, and the 
national security;
