BPA has no comments on the substantive requirements of the document, however, BPA  wishes to note that BPA appears to fall into two categories that are inconsistent with each other.  BPA is listed in Attachment 1 of the document as a 'Primary Department of Energy Organization to which DOE N150.X is applicable' for which a COOP implementation plan (emphasis added) is required.  Elsewhere in the document under section 5 g describing Responsibilities for Heads of Field Elements for which COOP plans in accordance with FPC 65 (emphasis added) are required, the power marketing administrations are referred to in subsection (1).  Thus it appears that this document is addressing BPA both as a Primary Department and a Field Element.  When this document is finalized, this inconsistency must be addressed and cleared up.

In the context of the requirements this document is setting forth, BPA is currently developing COOP plans that address the elements in FEMA FPC 65 which is a requirement for Field Elements.  Our reading of this document is that Primary DOE organizations need only develop a COOP implementation plan 'to support execution of the department's essential functions'  BPA has essential functions, and will not just 'support execution of the essential functions', we will be performing essential functions.  We will have actual COOP plans in accordance with FEMA FPC 65, and thus, within these definitions, we are a 'Field Element'.]]></Comments>

(EM) systems that incorporate the elements required within FPC 65 may be using their EM system as their viable COOP capability.                   <ResponseContent><![CDATA[1st Comment:  For purposes of a DOE directive, the requirements and responsibilities are clearly specified in section 4.b.(3).  The DOE COOP plan will further identify what essential functions may be transferred from Headquarters to specific field elements during a COOP event (devolution).  Field elements will then be expected to make provisions for executing those functions in their respective COOP plans.  Decisions regarding the continuation of essential field element functions under COOP is the responsibility of the head of the field element.  If the field element is directly impacted by an event and therefore must activate its COOP Plan, only the essential functions are expected to be performed from the field element’s alternate location.  If the field element is not directly impacted by an event but the overall DOE COOP Plan is activated, local operations should continue as normal unless the head of the field element determines that some operations need to be curtailed due to local security conditions or other competing priorities.
2nd Comment:  Emergency management plans and continuity of operations plans serve very different purposes.  Emergency management plans address operational emergencies occurring at facilities or related to activities under the cognizance of the field element.  These plans are intended to address situations of relatively short duration.  On the other hand, COOP plans are intended to address the provisions necessary to continue essential business activities and functions in the event that Federal facilities cannot be quickly reoccupied after an evacuation or emergency.  While there may be a few areas of overlap, the Office of Security agrees with the DOE Office of Inspector General’s view (reference DOE IG Report 0657, August 2004) that field elements need a stand-alone continuity plan to ensure that all of the required planning elements have been addressed.  As a result, SO does not want to encourage integration of emergency and continuity plans whenever possible but only as a means to eliminate any duplication of effort.  To clarify this point, the second sentence of 4.a.(2) and paragraph 4.b.(3)(b) have been deleted.]]></ResponseContent>

Comment:  The need for this Notice as written is questionable. I could not find anything written that is better defined than what is already included in FPC 65.  Since it states that the COOP will address 'all of the program elements specified' in FPC 65 -- what additional requirements were levied with this Notice?  It appears that all elements of FPC 65 applies to all levels. Perhaps the responsibilities section is the only new item.  The entire 'Requirements' section could be reduced to paragraph 4.a.(1) with the addition that each level (HQ, Organizational, field element, etc.) will develop a COOP, must be coordinated through the next level and with support organizations, and must address all the program elements specified in FPC 65.  It is confusing why some parts of FPC 65 were identified and others which are major considerations for COOP were not even mentioned (e.g., human capital, communications, exercises and training, and reconstitution of activities). 
1.	Lack of a Glossary or definition section. There are several places within the Notice where definitions are given. Recommend these be pulled out of the text and be place in a separate glossary or a definition section. For example, 'all hazard emergencies' is a term used by Department of Homeland Security. Does the DOE definition match up with that from DHS? 'Primary DOE Organization' should be defined. Paragraph 4.b.(3) has the definition of 'field element' in the middle of the sentence. This should be placed in a definition section -- not in the middle of a sentence. COOP vital record definition should be in a definition section (paragraph 4.b.(2)(f)). 
2.	The Notice does not apply to contractors. It is a mistake not to make this applicable to contractors as they are responsible for carrying out the mission essential functions of DOE/NNSA. Without their having a functional COOP in place, DOE/NNSA will not be able to carry out its main mission in many areas. Recommend that COOP responsibilities be identified for contractors. 
3.	There is no mention of a Guide being published by DOE/NNSA to address questions concerning the COOP planning process (e.g. how to identify essential personnel, how to ensure they are qualified, what are the training requirements, how often does a drill/exercise need to be performed, etc.) 
4.	Training and exercises. There was little or no mention of drills, training, or exercising COOP. 'Testing, training and exercising of COOP capabilities are essential to assessing, demonstrating and improving the ability of agencies to execute their COOP plans and programs.' Recommend having section that discusses these requirements. 
5.	Duration of operations. No mention of being able to operate up to 30 days from an alternate location as stated in the FPC 65. If this is not included in the Notice it will not be accomplished.
6.	Identification of essential support functions. I did not find anything regarding identifying essential support functions that are necessary for the essential function to operate successfully (for example, information technology support). 
7.	Communication. I did not find anything regarding interoperable communication and determining communication links and capabilities.

                  <ResponseContent><![CDATA[1st Comment:  Item 4.b.(3) of this Notice states the field element requirement to develop COOP plans in accordance with existing Federal continuity planning guidance.  Additional DOE-specific guidance to the field is forthcoming but will not be promulgated through the directives system at this time due to the exigency expressed in this IG recommendation.  This Notice has been subject to an expedited development, comment, and review process in order to issue departmental continuity planning requirements as quickly as possible.
2nd Comment:  The impetus for developing and issuing this Notice was DOE IG Report 0657 of August 2004 which correctly indicated that â€śthe Department did not provide sites with specific direction regarding the preparation of continuity of operations plans,â€ť and â€śhad not developed specific guidance for preparing such plans.â€ť  The Notice establishes the requirement for field elements to develop COOP plans in accordance with Federal continuity planning guidance.  Furthermore, the Notice identifies, formalizes, and promulgates DOEâ€™s essential functions to support Headquarters and field element COOP planning and incorporates new requirements related to COOP readiness (COGCON levels).  The Notice does not reiterate all of the requirements of FPC 65 because it is intended to clarify which COOP program elements are addressed primarily by the overarching DOE COOP plan versus those that are addressed primarily by office-specific COOP implementation plans or field element COOP plans.  In addition, not all FPC 65 program elements apply to all organizational levels.  The DOE COOP Plan will cover many requirements, such as alternate facilities and essential functions, that are not expected to be further defined in Headquarters office-specific COOP implementation plans and some field elements may have no essential functions beyond those already identified in attachment 2 of the Notice.
Comment 1:  There is no need for a glossary for this Notice.  Office of Primary Interest is aware of a formal definition of â€śall hazard emergencies.â€ť  This term was taken directly from FPC 65 and is not listed in the glossary for that document. The DOE Primary organizations are listed in attachment 1 as is standard practice for DOE directives.  The explanatory text related to DOE field elements in item 4.b.(3) is for clarification and is not a definition.  It is customary to include this information in the text of a directive.  Vital records are already clearly defined by the text as those records necessary to execute essential functions and reconstitute normal operations after an emergency.  36 CFR 1236 provides additional details regarding vital records if needed by someone implementing the requirements of this Notice.
Comment 2:  Although contractors may carry out essential functions on behalf of the Department, it is the sole responsibility of Federal entities to develop continuity of operations plans and make arrangements to ensure that essential government functions can continue in an emergency.  Business continuity or disaster recovery plans developed by DOE contractors may be of use in developing field element continuity of operations plans.  Field elements are also encouraged to consult DOE plans and procedures that have been developed in accordance with DOE Order 137.1A, â€śPlan for Operating in the Event of a Lapse in Appropriations.â€ť  This Order also applies to all Departmental elements but not to operating contractors even though some contractor operations are likely to be significantly impacted if Federal employees are not available to monitor operations.
Comment 3:  Guidance will be issued as soon as possible but, due to the exigency of this issue as expressed by the DOE Inspector General, it will not go through the directives system at this time.  Therefore, it is not referenced in this Notice.
Comment 4:  The Notice does not reiterate all of the requirements of FPC 65 because it is intended to clarify which COOP program elements are addressed primarily by the overarching DOE COOP plan versus those that are addressed primarily by office-specific COOP implementation plans or field element COOP plans.  Tests, training, and exercises are adequately addressed in FPC 65 which is required to be implemented by DOE Headquarters under section 4.b.(1) and by field elements under section 4.b.(3).
Comment 5:  While the 30 day duration is referenced in FPC 65, it is a guideline for planning purposes and not a hard and fast requirement.  It is more important to be able to sustain performance of the essential functions until normal business activities can be reconstituted.  FPC 65 simply indicates that this â€śmay be up to 30 daysâ€ť.

(4)  Training and exercises.  There was little or no mention of drills, training, or exercising COOP. 'Testing, training and exercising of COOP capabilities are essential to assessing, demonstrating and improving the ability of agencies to execute their COOP plans and programs.'  Recommend having section that discusses these requirements. 
(5)  Duration of operations.  No mention of being able to operate up to 30 days from an alternate location as stated in the FPC 65.  If this is not included in the Notice it will not be accomplished.  

(6)  Identification of essential support functions.   I did not find anything regarding identifying essential support functions that are necessary for the essential function to operate successfully (for example, information technology support).  
(7)  Communication.  I did not find anything regarding interoperable communication and determining communication links and capabilities.

However, the match is not perfect, and I feel that further development to define what types of emergencies constitute emergencies for which the COOP would be triggered need to be examined.  

Technically, emergencies are declared within the DOE system as defined in 151.1 Comprehensive Emergency Management System.  Yet, the COOP Notice seems to expand this definition to technicological emergencies.  These types of "emergencies" are somewhat alien to traditional emergency management but they have been fleshed out further in cybersecurity plans.  The way that DOE attempts to marry these elements should be further discussed and made formal in the Notice.  It may mean that 151.1 should be revised to include a category of emergencies that are reported to the EOC and up the chain of command that rest on technicological failures caused by hackers, power failures that outlast back up batteries or generator fuel, viruses, building conditions that disable the computer networks, such as flooding or smoke damage that may not rise to the level of a full blown operational emergency but which may precipitate a break down of computer functions; or other types of cyber attacks.  These types of emergencies have trickle down affects on site safety and physical security, so eventually an emergency might be declared based on the compromise those systems' integrities.  However, it might be an advantage to trigger an operational emergency as early as possible based on the failure of computers and other important information technologies as well as have a formal administrative link between the two programs.

To further the idea of COOP triggers as emergencies, it seems there should be a trigger for reporting local COOP activation to HQ.  Alternate sites should also be considered.  If the COOP plan is triggered at one facility or at HQ, do the alternate sites declare a "COOP emergency" also, and should they report through the DOE EOC that they are activated, or will there be a separate office or person to acknowledge the activation?

DOE should have an active interest in what field sites have determined locally to be those programs that support the DOE essential functions.  There should be a HQ review of local site COOP plans to ensure that the programs or projects that field sites believe support DOE essential functions are ones that DOE agrees with.  There should be a criteria established that by which field sites may consistently make these evaluations.]]></Comments>

            <SectionTitle><![CDATA[4. REQUIREMENTS b. COOP Planning. ]]></SectionTitle>
            <SectionContent><![CDATA[b. COOP Planning.  
(1) The DOE COOP Manager will develop an overarching DOE COOP plan based on the department’s essential functions identified in attachment 2 of this Notice.  The DOE COOP plan will address all of the program elements specified in Federal Emergency Management Agency (FEMA) Federal Preparedness Circular 65 (FPC 65), Federal Executive Branch Continuity of Operations (COOP).  In addition, the DOE COOP plan will specifically address the following.
(a) Alternate locations where Headquarters personnel will be expected to execute the essential functions if feasible under the event circumstances.
(b) Plans for transferring the responsibilities for executing the essential functions from Headquarters to one or more field elements if an emergency renders leadership and staff incapable or unavailable to operate from the designated COOP locations.
(c) A decision process for activating the DOE COOP plan with or without warning and the process for notifying designated Headquarters employees and other Departmental elements of COOP plan activation. 
(d) The concept of operations for executing the department’s essential functions at one or more alternate locations.  All functions deemed not essential to the immediate needs of the department will be deferred until additional resources become available and as the situation permits.  In the immediate aftermath of a event affecting DOE Headquarters operations, the department will assemble the smallest staff necessary to support leadership and execute the essential functions.  This staff may be augmented over time.
(e) The actions that will be taken to meet the requirements of reference 6d during elevated levels of concern as directed by the FEMA Operations Center.
(2) Each Primary DOE Organization must develop a COOP implementation plan to support execution of the department’s essential functions and implementation of the DOE COOP plan.  The COOP implementation plan must address the following.
(a) Orders of succession to key positions within the organization to ensure the organization’s ability to support the execution of essential functions when necessary.
(b) Predetermined delegations of authority for making policy determinations and decisions that can take effect when normal channels of direction are disrupted and any limits to delegated authorities.
(c) The process for notifying their employees of COOP plan activation and conveying response expectations.
(d) For those offices that are responsible for performing or directly supporting the essential functions, procedures for executing their essential functions from alternate locations designated under paragraphs 4b(1)(a) and (b) above.
(e) The personnel qualified to execute the organization’s essential functions during a COOP event.
(f) The communications systems, vital records, data management software and equipment, databases, and other information, including classified and other sensitive data and communication systems, necessary to execute the organization’s essential functions from alternate locations and to reconstitute normal operations after an emergency.  COOP vital records include emergency operating records and legal and financial records as defined by 36 CFR 1236.
(g) The mechanisms that will be used to protect and ensure ready access to the information identified under paragraph 4b(2)(f).
(3) Each DOE field element (For the purposes of this Notice, this term includes operations offices, service centers, site offices, area offices and regional offices of federally staffed laboratories) must develop a COOP plan that addresses the elements in FEMA FPC 65.  
(a) The degree of field element COOP planning will be commensurate with the organization’s role in supporting execution of department’s essential functions and the extent to which an event directly affecting the field element would impact the continuity of both departmental and local essential functions.  
(b) The COOP plan may incorporate other plans or procedures by reference.  If so, the COOP plan must specify what COOP program elements the referenced documents address, how they are maintained up-to-date, and how revisions and updates are coordinated with the COOP plan.  
(c) In conjunction with the provisions of FPC 65, COOP plans for field elements must specifically address the following elements.
1 Local time sensitive actions that must be taken to support the essential functions identified in attachment 2 when the field element is not directly impacted, such as directing increased site security measures.
2 Procedures for executing essential functions that have been transferred from Headquarters to their locations in accordance with the DOE COOP plan.  
3 Local essential functions that must be continued under any and all circumstances for an event that directly impacts the field element.  The essential functions for an event directly impacting the field element will be based on those functions that must continue with minimal disruption or cannot be interrupted for more than 12 hours without compromising the organization’s ability to execute the department’s essential functions at the local level.
4 Provisions for executing or supporting execution of essential functions from one or more alternate locations.  In addressing this requirement, field elements must take maximum advantage of existing field element infrastructures and consider all of the options identified in Annex E of FPC 65 to determine the most cost effective approach.  The plan should identify whether the field element essential functions can be executed from Headquarters or another DOE field office during an emergency.
5 A decision process for the head of the field element, his designee, or his successor to activate the organization’s COOP plan with or without warning for an event affecting the local area.
6 The process for notifying employees, DOE Headquarters, and other Departmental elements of activation of the field element’s COOP plan.

                  <ResponseContent><![CDATA[Comment 1:  The requirement to coordinate the COOP program among various DOE elements and organizations is already identified as the responsibility of the DOE COOP Manager under section 5.d.  By its nature, the DOE COOP Plan will be a coordinating mechanism in that it will identify, for example, field element devolution sites and mechanisms for communicating among field elements during COOP events.  In addition, the DOE COOP Manager will be issuing guidance to field elements shortly which should serve promote some degree of consistency and integration among Headquarters and field element COOP plans and COOP implementation plans.
Comment from Thomas Crandall on alternate locations:  Item 4.b.(1)(a) addresses the overall DOE COOP plan which will identify the alternate locations for Headquarters personnel.  As indicated in item 4.b.(3)(c)4, requirements pertaining to field element alternate facilities states “one or more alternate locations.”  For field elements, the number and types of alternate facilities to be used during an event requiring COOP plan activation should be commensurate with the number of essential functions that must be continued, how critical those functions are to sustaining essential government/DOE functions, and how vulnerable the alternate location(s) may be based on a risk assessment as described in FPC 65.  Guidance to be issued shortly to field elements will contain more detail on selection of alternate locations.
Comment 2:  Item will be revised for clarification by truncating the sentence and adding a second sentence that reads “Delegations of authority must include a clear description of the circumstances under which the delegated authorities would take effect and any limits to the authorities delegated.
Comment 3:  Item 4.b.(2)(d) will be revised to state “....., assignment of specific responsibilities and procedures....”
Comment 4:  When the DOE COOP plan is implemented, Headquarters elements will be in the process of relocating to alternate facilities and, at the time, individual DOE field elements may or may not be directly impacted by the threat or emergency.  If a field element is directly impacted, it is the responsibility of the head of the field element or his designee to make decisions regarding local COOP plan activation (under item 4.b.(3)(c)5) or curtailment of specific operations based on local conditions.  If the field element is not directly impacted, it is expected that local operations would continue but additional responsibilities may take effect under increased SECON levels or essential functions transferred to the field element form Headquarters.  These decisions are expected to be made by the heads of field elements, not by Headquarters offices.
Comment 5:  Provision for developing and maintaining vital records and information management system is already required under item 4.b.(2)(f).  If real-time data and information is necessary to execute an essential function, that information should already be available at a designated alternate location (i.e., devolution site) as required by items 4.b.(2)(f) and (g).
Comment 6:  The first proposed sentence is not accurate because field elements are required to plan not only for functions transferred to them from Headquarters under 4.b.(2) but also for local essential functions if the field element is directly impacted by an event requiring activation of the field element COOP plan.  For the second proposed sentence, the impetus for developing and issuing this Notice was DOE IG Report 0657 of August 2004.  In that report, the DOE inspector general notes that field elements need a stand-alone continuity plan to ensure that all of the required planning elements have been addressed.  The Office of Security agrees with this view and, as a result, does not want to encourage integration of emergency and continuity plans when possible but only as a means to eliminate any duplication of effort.  Emergency management plans and continuity plans serve very different purposes.  To emphasize this point, paragraph 4.b.(3)(b) has been deleted and the second sentence under 4.a.(2) has been deleted.
Comment 7:  Applicable paragraph has been deleted.
Comment 8:  It is appropriate to add a proviso to the Notice indicating that local conditions may preclude a field element form performing essential functions transferred from Headquarters.  Thus, item 4.b.(3)(c)2 will be revised to include the caveat that field elements are only expected to execute essential functions transferred from Headquarters as permitted by local conditions.  The draft DOE COOP plan will incorporate the concept that Headquarters essential functions will not be transferred to a designated field element (i.e., devolution site) if that field element has been impacted by an event rendering it incapable of executing those functions.  If the field element is impacted such that it cannot continue its own essential site missions or operations, that is an event whereby the field element should be considering activation of their local COOP plan.  The requirement to notify Headquarters when the local COOP plan is activated is identified in item 5.g.(2).

Comment:  4b(e)(3)(c)4.   As written, this paragraph was more restrictive than it needs to be.
â€śProvisions for executing or supporting execution of essential functions from one or more alternate locations.  In addressing this requirement, field elements should take advantage of existing field element infrastructures and consider the options identified in Annex E of FPC 65 to determine the most cost effective approach.  The plan should identify whether the field element essential functions can be executed from Headquarters or another DOE field office during an emergency.â€ť  (NA-40/Kiell)

Comment:  Paragraph 4.b.(1) This paragraph indicates that the plan will address additional requirements to those listed in FPC 65. The subparagraphs do not provide anything updated to what is already included in FPC 65. Recommend the removal of the words 'in addition' and change the wording of 'will' to 'must'. Paragraph 4.b.(1)(b) -- One of the concepts of delegations of authority is to state under what conditions this will occur. There is no mention of this is the Notice.  This is an important step that must be included or the 'Haig' syndrome may take over. It also needs to be clearly defined how or when this delegation will be ended. Paragraph 4.b.(1).(d). This paragraph leaves a big gap in the planning aspect for COOP. According to FPC 65, deferred organizations are to be notified when they are deferred. This is not stated in the section. If a department is notified that COOP is being implemented but they do not have any COOP plan, that department will be wondering what to do and could tie up essential phone lines trying to find out their responsibility. Recommend a statement be included in the Notice requiring notification of deferred organizations that they will be shut down until additional resources become available. Discussion about staffing needs to be beefed up.  A staffing plan should be required in any COOP but this is not mentioned here. A statement also needs to be included for turnover of staffing. I believe this is a requirement of FPC 65. Paragraph 4.b.(1)(2).  This paragraph needs to be strengthened. How is someone going to plan for actions to meet the attachment to this letter, if it has been misplaced?
