DOE faces a quandary.  There seems to be a deficiency in the mechanism to reflect the requirement to have a TS/RD and TS/NSI identification and control system.  This is a more serious issue in light of Deputy Secretary MsSlarrowâ€™s September 4, 2003 testimony to the Senate Committee on Energy and Natural Resources concerning the Department of Energy Polygraph Program.  Whereas that is a separate issue, it appears to be part of the impetus for crafting this document.  In that testimony, DepSec McSlarrow outlined his intent to enact substantial changes in the way DOE will manage regular and routine access to Top Secret information or material.  His comments indicated a review of all Sigma (especially Sigma 1, 2, 14 and 15) information was necessary to determine whether all or any part should be upgraded to Top Secret or moved into a Special Access Program.  Creation of Sigma 20 addresses part of the issue, but not all.  Somewhere, sometime, someone is going to have to start flesh out policy covering how individuals with access to TS/RD and/or TS/NSI will be identified and their access managed.  This document could incorporate procedures covering those concerns, but as written, it does not answer all parts of the requirement.]]></Comments>

               <Comments><![CDATA[Comment:  I am forwarding again the comments (see below) on the security draft which were made by the two gentlemen (Smith and Sigmond) who administer our classified mutual defense agreements with France and the UK.  Their comments are based on practicality, a long history of what works well as it is, and international agreements established by the highest levels of the US Government.  Thus, their comments, which I strongly support, deserve close attention.  

Further, aside from the immediate concerns of administering our international agreements, I can't imagine how the weapons complex would do what this draft order would require.  It is far to cumbersome, unworkable and mired in the details.  It would create chaos and a false sense of security.  Some problem identification, alternative solutions, reality checks and cost/benefit analyses are required.   (SME: NA-113/Van Fleet)

Comment:   Big picture:  I believe Ward is right on with his review of this draft order (see his comments below).  Absolutely unworkable.  This is a very expensive "solution" to a “problem” that isn’t identified, a solution that adds an unnecessary layer of complexity and bureaucracy to an already complex classified matter protection and control scheme.

As Per International Agreements:  The order gives the Classified and Controlled Information Division (CCID) at the NNSA Service Center the authority to determine what foreign governments will get access to Nuclear Weapons Data.  The order will require foreign nationals who receive NWD to be entered into the WDACS system (I believe they are not entered in the system currently).  Then the NNSA sponsor of the international agreement will have to "coordinate" with the CCID for access to NWD.  As you know, we are required to keep subject matter confidential under the terms of my agreement -- this order would open that up to the CCID and everyone with access to the WDACS system.

Solution:  SO will have to give an exemption for all properly authorized international agreements.  SO must acknowledge that the President, the Congress, and the Secretaries of Energy and Defense have already decided that we should share certain information with certain foreign governments, and that SO is not authorized (and should not be authorized!) to regulate these exchanges. Comment:  A cursory analysis of the referenced directives generated a number of concerns.  I believe these directives represent a sincere effort on the part of well meaning security people to increase the protection for Nuclear Weapons Data (NWD).  However, the problem is that they are trying to apply an ideal solution in a real world where there are constraints of time and money. 

The directive and manual requires all NWD to be marked with the appropriate Sigmas and access to NWD to be restricted to only those persons who have been approved for the specific Sigmas.  Records are to be maintained of which Sigmas an individual has been approved access to and the approval is to be renewed annually.  Documents are to be marked indicating what Sigma data is contained there in.  Before anyone is authorized to receive a document with NWD information, view its contents, or discuss it, the person providing the information must verify that the recipient is authorized to receive that Sigma data.  If a document has Sigma 3 and Sigma 4 data but the intended recipient is only authorized access to Sigma 3, he/she is not permitted to receive the document.  These rules apply to data transmitted to the UK as well.  This will require us to maintain a data base of Brits and which Sigmas they have access to.  The Brits will not be able to share the data with other Brits unless they verify the other Brit also has the appropriate US authorizations.  As the order is currently structured, the Service Center is the approval authority for "foreign governments and international organizations".  I am not sure how we will maintain a data base of foreign nationals that have been granted access to NWD.  Maybe we can assign all of them social security numbers!

My experience is limited to Headquarters and at this level, I see one of two things happening.  Either, everyone will be granted access to all Sigma data, or, things will be so compartmentalized the program will be sub optimized to a far greater extent than it is now.  This appears to be a well intentioned idea but impractical to apply, at least at the Headquarters and international levels.

Specific comments:
1.	It would be helpful to me if the directives contained a brief description of what is trying to accomplish.  I can see benefit for limiting access to Sigma 20 but not for the other Sigmas with the exception of Sigmas 14 and 15 which are mentioned but not included in the directives.
2.	I do not think it is appropriate for the Service Center to approve authorizations for the UK program.  The Service Center has no programmatic responsibility and they are too many time zones away from London.
3.	Who is going to be responsible for the massive data entry and maintenance associated with this requirement?  The more people that  input data into WDACS the greater the chances for corruption.
4.	Passing clearances will be much more time consuming, unless everyone gets every Sigma which defeats the purpose of the orders.
5.	The Office of the Assistant Secretary of Defense for Nuclear Matters is responsible for authorizing DOD personnel.  They will need additional people to process the clearances for Standing and Safety Committee Meetings and ensuring only the authorized people are permitted in the room for the different topics that come up on the agendas.
6.	Electronic media on servers will also present a problem.  All of the documents on the server would be classified as active and require the new markings.  Will there be a server for each Sigma and all combinations of Sigmas?  
7.	Will there need to be separate safes for each Sigmas and combination of Sigmas?
I think we need to go on record stating that this idea needs more work.

Comment:  It is my feeling that overall these are two very good documents. Major changes include but are not limited to document marking for NWD documents and the Service Center being the main POC for access to NWD. I would like to see a chart that shows who approves what visits and who does the WDACS data entry. I have done a sample chart

It is my opinion that Headquarter should maintain approval authority for anyone that headquarters holds the Q on. This includes most OGA's CIA, State, Congress etc. Headquarters should also maintain control of the foreign national approvals that we currently approve and will require Headquarters approval per DOE O 142.

Comment:  Los Alamos National Laboratory will have major comments to submit on this Manual. These comments are currently in the draft stage but will be finalized and submitted hopefully by January 16, 2004.   (Los Alamos/Griego - SME/Salaz)

Comment:  Why does the manual include Sigma 20? Sigma 14/15 is not included because they are in a separate manual.  Sigma 20 will also be in a separate manual.

In contrast, the drafted requirement would impose a significant addition in measures and recordkeeping to be performed with a doubtful improvement in security. 

EXAMPLES: Order 471.X 4e(1) Authorization for personnel to access Sigma 1 category will be granted.
4e(2) Authorization for DOE or NNSA personnel to access Sigma 1 category. 
5f(3) Grants or denies waivers or deviation requests from the requirements of this Order, the CRD, or Manual 471.X-Y, relating to Sigma 1 material. 
(15) Using WDACS provides authorization to access Sigma 1 NWD. <16> Grants and records in WDACS authorization to access Sigma 1 NWD. <17> Grants and records in WDACS authorization to access Sigma 1 NWD. 
g(1) Designate from each access to Sigma 1 NWD.

The Order needs to clearly state that it does not cover Sigma 14 and 15 which is covered by DOE Manual 452.4-1.
The requirement to protect Computer Systems that contain NWD the same as for other media may be an impact to Computer Systems at SNL/NM. For example, the IMS/CMS databases on the SCN contain NWD; the draft order would require that all users be certified for NWD; that is not the case now. It may be difficult to partition the NWD in these databases to control access.
Sigma 20 will probably be better handled in the same Manual (or similar manual) that covers Sigma 14 and 15 since it parallels requirements for Sigma 14 and 15. 
Sigma 20 Site Coordinators and Sigma Authorizing Officials have overlap in responsibilities. Also, this appears to be a major resource impact to SNL/NM. 
Many of the responsibilities under Manager, Classified and Controlled Information Division, NNSA Service, are better suited under Assistant Deputy Administrator for Military Applications and Stockpile Operations since they are more intimately involved with NWD and therefore should control access to NWD. Delegate Ashley McConnell for Sandia National Laboratories To avoid significantly hampering efficient and economical performance: RECOMMENDATION Change, through out the Order and Manual, the required Sigma authorization from any Sigma category to Sigma 1 category and Sigmas 1, 3, 3V, 4, 11, 12 and 13 to Sigma 1. Comment:  Overall comment - neither the order or manual provide guidance on how to request the listed Sigma access, justification for access, or any records retention requirements as these are official record files.  (SME:  Sandia/Bechnell)

Comment:  Sigma 11 needs to be reworded to reflect the program desires.  I would hope that the type of information protected includes issues such as implosion mesh zoning and handling; as well as possibly details of High Energy Density Physics Experiments that relate to Stockpile Stewardship. 

Some "minor" items would cause extreme problems for the weapon community.  Approval at the Federal level prior to access at the contractor level would be a non-starter.  This requirement calls into question the status of a "Q" clearance at laboratories.  We should understand that access to information requires a clearance and need-to-know.  An established Sigma system is a process for handling need-to-know determinations in a process consistent throughout the complex.  

The SIGMA system should not be the need-to-know determination that must be originally made in the hiring process by all managers with NWD information in their program.  That is to say that Managers hire someone having the appropriate clearance to work with NWD are making a need-to-know determination.  Whatever additional layers of Sigma approval DOE/NNSA feels the need to add, would best be added into the hiring process, if at all

On site, the access by Q-cleared personnel to NWD should  be a completely local determination and ad hoc.  That is to say the fact that Employee ABC needs access to an on-site meeting for general Nuclear Weapon Data (currently Sigma 1-10) should be local determination with local controls regardless of what the system has electronically.  

Formal Sigma assignments for basic weapon data should only come about when the supervisor wants to approve authority to receive program documents, or the individual needs to travel to anther site.

Sigmas 11, 12, 13, 14, 15, 16, and 20 are the exceptions that require additional controls internally, although 11, and 16 do not even fit there if sigma 11 is defined properly as a subset of sigma 1, and 16 only applies to documents as envisioned in recent meetings on the subject.

The order continues with a schism in the NWD aggregate.  The NWD Order must address all the Sigmas.  Since there will be at least two manuals that address sigma handling, the Order should indicate which manuals to go to for each Sigma grouping that is desired.  

I would group the Sigmas as 1-10 & 16 for general first and second generation weapons data, Sigma 11: Inertial Confinement Fusion (ICF), Sigma 12-13: Nuclear Directed Energy (NDEW), Sigma 20: Improvised Nuclear Devices (IND) and Sigma 14-15 Use Control (UC).  I realize the names used here are simplifications. 

I would strongly suggest that the Sigma 20 be removed except for a small portion that says who manages/controls it under the provisions of the order, and a separate Manual be issued.  

Sigma 14/15 should also state up front who has overall management and control policy responsibility and address the reference to the manual  (M 452.4-1) covering those Sigmas.  If 12 and 13 were to be reactivated as a program, I would also recommend their breakout as well.  The organization having control for 12 and 13 management should be identified.

One of our program representatives would suggest modification of O471.X and M471.X to (1) reference DOE M452.4-1 up front (the draft order currently does not), (2) add the Sigma 14/15 Coordinator roles to the appropriate sections, and (3) at least put a placeholder in to refer to the controls in DOE M452.4-1 for Sigma 14/15 materials.  I agree with her (it states more clearly what I said in the previous paragraph).

Implementation of this order could result in a number of snafus, not unlike the implementation of M 452.4-1.  Some of the issues are probably minor.  For example, all new cover sheets will be needed, since the terminology is different than that which currently exists (see manual section 4.b.2).   However, will we need to pull all existing cover sheets and do a 100% update/replacement?   The manual leaves no provision for leaving the old ones in place, or allowing comparable language.

SIGMA 11 - The Definition here should recognize that the information is essentially Sigma 1.  If we do not eliminate this Sigma it should have approximate parity in handling (if not outright equivalence) with Sigma1

SIGMA 20 - Several issues pop up immediately.

Recovering old "out and about" IND documents.
Remarking and coversheets
No in use policy.
WDACS input prior to access and use ... creates an undue administrative burden on those responsible for maintaining records of programmatic determinations.
Encryption on classified systems rather than password access seems to be overly restrictive with no tangible benefit.

The "segregation" requirements need to be better defined (see section 6).  It would appear that a and b require locked storage even within vaults/VTRs, while c merely requires a repository.  And, does separation (especially for c) mean separate hanging file, separate drawer, or separate safe?  Similarly, for computers, will segregation be required in terms only of access to systems (section 8), or will separate media/drives/etc. be required?

One of the largest issues in implementation will be the requirement in 2.a to re-mark existing documents.  This will be a massive, time-consuming effort.  It will be compounded by the vague definition of "inactive".   For example, will "inactive" material need to be stored away from actively accessed material?  Or, can I keep my old documents in my safe "as-is" as long as I swear I haven't touched them (except as allowed in the manual)?   Personally, I think the "inactive" strategy will also lead to the same issues that came up when we were asked to implement Sigma 14/15.  If inactive documents are pulled up (perhaps by a current custodian without sigma 20), will they know to re-mark these documents correctly, and know that they need to immediately give them up?

In LLNL's security refresher briefing, it states that a "Q" clearance is required for SRD and for SFRD.  Individuals with a DOE "L" are not permitted SRD. Note: this is the result of a lack of clarity as to whether SRD non-weapon data could be accessed by an "L" cleared person, if the requirement is that they do not access weapon data at all.  Here they can only see CRD (Can it be weapon data? actually it can be but rarely is.) and SFRD that contain no weapons data (without DOE approval).  However, the table in Appendix A shows "L" cleared personnel are eligible for Sigmas 1 - 13.  Have the rules changed, or is LLNL being more restrictive?  I think that this table is not correct.

The protection of who has what authorization(s) is a focus for the WDACS design / implementation team. No exemption from SO is required.  They are not the lead for the protection of nuclear weapon data (NWD) per the current delegations from the Secretary. Per agreement with the Use Control Program Coordinator, the requirements from DOE Manual 452.4-1 (or its successor) will be inserted into these directives prior to publication and Manual 452.4-1 will be withdrawn.

Requirements for other U.S. governmental agencies entities will be removed from these directives.  DOE / NNSA personnel will be responsible for entering the data into WDACS for any personnel from other U.S. governmental agencies that are granted access to classified nuclear weapon data. CCID will pursue changes to the NISPOM to incorporate requirements for access to classified nuclear weapon data by other U.S. governmental agencies.

Separate servers for each Sigma category, or combination of categories, are not required by these directives.  These directives only restate the existing requirement to have need-to-know controls on classified information.  If, for example, an Administrative password allows access to all files, then the holder(s) of that password will have to have a documented need-to-know for all of the Sigma categories in the files.

1. A major problem of the current draft is its attempt to make a distinction between the NWC and DOE.  This distinction is found in the old NWD order but was not followed as it was found to be unworkable.  Today, the interrelationships are even more complex with the creation of the NNSA and the dismemberment of the old Defense Programs organization into a number of DOE staff offices.  Too many offices in DOE require access to NWD on a continual basis for a process that seeks to limit flow of information via the service center to be efficient or effective for DOE.

Another problem would occur for congressional work.  The current draft also specifies that communication and control of weapon data to and from Congress will be handled through the service center.  It is doubtful such a system would be responsive to the immediate needs of Congress.     
Headquarters should control the flow of nuclear weapons data to Congress.
Overall, the revised manual attempts to severely restrict the flow of NWD.  While prudent control of access is laudable, a system designed to create massive delays and inefficiencies would not appear as a step forward.  Therefore, we recommend deleting all references to “outside the NNSA” and “non-NNSA” and using instead “outside the DOE” and “non-DOE.”  We have noted places to do this in our specific comments below.  

2. In Chapter I, paragraphs 1 Responsibilities and 2 Requirements are already in the Order and should not be repeated in the Manual.  In addition, Chapter I should be retitled “Access Eligibility and Approvals” and should start with the information in paragraph 3 (on page I-9).

3. The cover sheet shown in the manual (Appendix C) is a GSA approved form.  It can only be modified with the approval of the GSA.  Has it been approved?  The CMPC states that “locally created cover sheets may be overprinted” (Page II-43, paragraph 3.x). a.	DOE Elements.  The requirements in this Manual apply to all elements of DOE 
and the National Nuclear Security Administration (NNSA) within the provisions 
and restrictions of Title 32 of the National Defense Authorization Act for fiscal

b.	Site/Facility Management Contractors.  
(1)	The Contractor Requirements Document (CRD), Attachment 2, sets forth 
requirements of this Manual that will apply to site/facility management 
contractors whose contracts include the CRD.
(2)	This CRD must be included in all site/facility management contracts that

(3)	This Manual does not automatically apply to other than site/facility 
management contractors.  Any application of any requirements of this 
Manual to other than site/facility management contractors will be 
communicated separately from the Manual.
(4)	Heads of Headquarters elements are responsible for telling contracting 
officers which site/facility management contractors are affected by this 
Manual.  Once notified, contracting officers are responsible for 
incorporating the CRD into the contracts of affected site/facility 
management contractors via the laws, regulations, and DOE directives 
clause of the contracts.
(5)	As the laws, regulations, and DOE directives clause of site/facility 
management contracts states, regardless of the performer of the work, 
site/facility management contractors with a CRD incorporated into their 
contracts are responsible for compliance with the requirements of the 
CRD.
a.	Affected site/facility management contractors are responsible for 
flowing down the requirements of this CRD to subcontractors at 
any tier to the extent necessary to ensure the site/facility 
management contractors compliance with the requirements.
b.	Contractors must not unnecessarily or imprudently flow down 
requirements to subcontractors.  That is, contractors will
1	ensure that they and their subcontractors comply with the 
requirements of the CRD and
2	incur only costs that would be incurred by a prudent person 
in the conduct of competitive business.
c.	Exceptions.  None
d.	Deviations.  Deviations from the requirements in this Manual must be approved

a.	Implementation must be completed as soon as possible, consistent with 
contractual requirements.  
b.	For any new requirements imposed by this Manual that cannot be fully instituted 
within 1 year of publication of the Manual or within existing resources, an 
implementation plan must be developed and submitted to the Classified and 
Controlled Information Division at the NNSA Service Center within 6 months of
